摘要
事实劳动关系制度存在偏离劳动法宗旨、法律规则失调的缺陷,应把其纳入劳动合同制度加以改造,具体的路径是把"用工"作为劳动合同订立的一种形式,以"用工"建构的劳动权利义务作为未来订立的劳动合同的基本内容。
There are defects exiting in factual labor relationship system, such as deviating tenet of labor law ,legal rules disorders. It Should be reformed by labour contract institution. The specific path is that considering the "labour" as a form of labor contract ,depen- ding on the labor rights and obligations constructed by " labour " to make up the basic contents of the future labor contracts.
