摘要
环境法泛道德化现象由来已久,且有越演越烈之势,致使环境法逐渐偏离法的轨道。环境法表象虽然很繁荣,但其背后却隐藏着专业性不强的危机,法律味不浓是环境法突出的特点。现今的环境法正在逐渐演变为如何保护环境的道德呼吁,难以体现环境法中的法律因子,难以适应现代化的法治实践。走出环境法泛道德化的阴影,实现环境法"法"的回归是当代环境法学者们努力的方向。
Pan moral phenomenon of Environmental Law has existed for a long period of time and has an intensified trend, which causes a result that environmental law has gradually deviated from law. Although the environmental law seems to be booming, but it is not professional and lacks law taste. Now the Environmental Law is becoming a moral call on how to protect the environment, which cannot reflect the legal factors and hard to adapt to the modern practice of law. Therefore, it is a direction for scholars to try to walk out the Pan moral phenomenon of Environmental Law and realize law regression.
