摘要
新中国选举制度的确立,以1953年3月《中华人民共和国全国人民代表大会及地方各级人民代表大会选举法》的颁布为标志。从研究新中国第一次全民普选入手,是深化对这一制度认识的一个途径。照顾少数民族选举权,规定中共党组织、民主党派、选民或代表的联合提名权以及选区划分、选民登记、代表候选人提名、投票与计票制度等选举运作程序与环节的规定,基本上为1954年宪法所确认,而且大都沿用至今。1953年选举法及其实施为新中国选举制度的确立及发展创造了初步的历史经验,无疑对于今天的选举实践,尤其是整个国家基层民主建设提供了借鉴意义。
Marked by the promulgation of the election Law of National People’s Congress of the People’s Republic of China and local People’s Congress at all levels in 1953, New China’s electoral system was established. Studying New China’s first nationwide general election campaign will contribute enormously to our understanding of this system. The election law of 1953 gave special treatment to ethnic minorities’ privileges to vote and stipulated the CCP’ rights of nominating candidates for election jointly with the democratic parties and electors or representatives, and it also provided the operating procedures and stages of election, such as division of congressional district, registration of electors, recommending candidates for deputies, casting and counting the electronic ballots. These provisions were basically acknowledged by the Constitution of 1954 and nearly all of them have been being used till now. For the establishment and development of new China’s electoral system, the formation and implementation of 1953 election law brought about rudimentary historic experiences, which afforded much significance for our present-day election practice, especially for our whole country’s democratic construction at the grass-roots level.
