摘要
劳动教养制度的改革不仅涉及人权保障,而且关系国家和社会的安全和稳定。劳动教养制度因程序性积弊需要进行根本性的变革。无论是理论还是实践上,停止劳动教养制度已经成为劳动教养改革中的优先选项。从公法的强制性整体变迁的角度看,在现有的法律制度框架内通过分流并和的方式改造劳动教养制度是最佳的路径选择。在维护社会稳定的前提下,适当降低犯罪门槛,科学配置刑罚与治安管理处罚之间的比例关系,辅以不完全性变迁的程序再造,劳动教养制度的整体性变迁的范式转换将得以平稳实现。
The reform of reeducation through labor system not only relates to the protection of human rights, but also concerns the safety and stability of the state and society. The reeducation through labor system needs radical reform because of its deep-rooted procedural abuse. Either in theory or in practice, to stop such a system is the first priority of the reform. From the perspective of an integrated transition of the enforceability of public law, to remold the system by the method of diffluence and conflation under the current structure of legal system is the best path choice. On the premise that society keeps stable, by appropriately lowering the threshold of crimes, scientifically allocating the proportion of criminal penalty and administrative punishment, and also incompletely rebuilding the system, the transition of an integrated change of reeducation system can be stably achieved. through labor
