摘要
运用文献资料法和逻辑分析法结合各类学校体育法律条例及涉及学校体育问题的有关法律对学校体育伤害事故做充分说明,详细分析体育伤害事故的类型及产生原因,提出学校体育伤害事故适用过错责任原则兼顾公平原则的观点。
This paper used the methods literature data and logical analyze, and combination with legal regulation of school physical education and school sports issues involved regarding the law on school sports injuries to full describe the school sport injury accident, than analysis the type and causes of physical injury. Finally, the paper put forward the opinion of that school sports injuries should take into the principles of fault liability and fairness.
