摘要
商标是符号经过商品化后的标志。在利用符号学基本结构的基础上,可精确地分析商标、显著性、驰名商标等基本概念,也可更深刻地解释商标权、混淆、淡化等商标基本理论。运用符号学讲授和研究商标法,可以克服经济学和政治学方法的宏观和粗糙,但符号学只能提供较细腻的制度分析工具,并不能着眼于建构宏大的理论。
Trademark essentially is the commercialized symbol. We can by the mean of semiotics, on the basis of deconstructing trademark from triadic or dyadic structuration, accurately analysis trademarks, distinctiveness and well-known trademarks, and can also profoundly interpret trademark right, confusion, dilution, and thoroughly annotate Assignments trademark in Gross and logo right. Semiotics can overcome macro and rough methods of economics and politics and provide a good and exquisite system analysis tool, but can't focus on construction of the grand theory on trademark.
