摘要
反补贴对中国企业出口产生的影响越来越大,研究美国反补贴的法律与实践变化,对于提高中国政府和企业应对反补贴的能力具有重要意义。论文首先阐释了关注美国反补贴调查发展的重要意义,然后基于我国上市公司2010年、2011年年报,对目前上市公司获得补贴的情况进行了分析,并根据WTO《补贴与反补贴协议》的有关规则,对国有上市公司100强企业目前获得补贴的风险性进行了全面评估,从政府、行业协会及企业不同角度提出了应对反补贴的对策。
Countervailing is generating increasing influence on the export of China＇s enterprises. To study the change in the law and practice of America＇s countervailing is important for China＇s government and enterprises to improve the ability to respond to countervailing. This paper firstly illustrates how important to watch the development of America＇s countervailing investigations, and then based on the data in 2010 and 2011 annual reports of China＇s listed companies, this paper makes an analysis on the situation of listed companies＇ receiving subsidies. And then according to the rules of WTO ＂Agreement on Subsidy and Countervailing＂,the paper makes an risk assessment for the one hundred biggest state-owned listed companies＇ situation of receiving subsidies, and puts forward some advices from three different angles： the government, the industry associations and the enterprises.
