摘要
目前中国农村社会保障立法严重缺失,对一些基本问题缺乏必要的规定;农村社会保障法律制度体系的各项内容缺乏具体、完善的设计,缺乏城乡统筹的衔接机制;对影响农村社会保障法律制度运行的各因素缺乏全面分析,无法建立良好、有效的保障机制。在农村社会保障制度立法模式上,国家应先建立农村社会保障法律体系,再逐步与城市接轨,最终建立起城乡一体化的社会保障法律体系;首先要制定《农村社会保障法》,然后在分类保障的基础上完善医疗保险、养老保险等具体制度的设计,同时建立良好、有效的保障机制。
The system of rural social security is relatively backward in china. The subsistent problems mainly include severe absence of legislation on basic principles; shortage of perfect system designs and lack of good security mechanisms. Therefore, firstly, the legal system of rural social security should be established and connected with cities gradually; and a uniform system of social security established at last, Laws on rural social security should be enacted before perfection of designs of various systems and establishment of a good security mechanism.
