摘要
承租人优先购买权是承租人基于租赁关系而享有的一项权利。对其概念,尚未有权威的定义。对其性质,也向来众说纷纭,大体有期待权说、形成权说、物权说、债权说等。探求该项权利的历史渊源及其本义,应将承租人优先购买权定义为一定条件下承租人主张其与出租人之间房屋买卖合同优先成立的权利,在本质上应视其为形成权、债权。
The priority to purchase of renter is based on the lease relationship. There's no authentic definition of this right. As for the legal nature of the priority to purchase of renter, opinions are widely divided, there are ap- proximately the expectant right, formation right, property right, creditor's right. To explore the source and the original meaning of the priority to purchase of renter ,it ought to be defined that the right that the renter can ad- vocate that the housing sale contract between him and the leaser is established prior to any others, it ought to be the formation right and the creditor's right essentially.
