摘要
在贯彻实施《防洪法》“谁设障 ,谁清除”原则时 ,要区分历史遗留障碍物和违法违章障碍物 ,以便正确适用“谁设障 ,谁清除”原则。特别是历史遗留障碍 ,由于历史原因 ,设障情况更是复杂 ,应区别对待 ,同样 ,对于违法违章障碍物 ,也须分清谁是真正的清障责任人。
On carrying out Flood proofing law principle of that person, who set barrier on river, needs to eliminate it, the barrier leaved from history and the current illegal barrier must be distinguished to apply the principle.
