摘要
现行劳动争议解决机制虽已涵盖协商、调解、仲裁、诉讼等四种途径,但因该机制中协商机制劳资双方力量失衡,调解机制调解委员会的作用甚微,仲裁制度功能偏离立法预期目标,诉讼制度难以恪守司法公平公正等弊病的存在,成为制约劳动争议及时、公平解决的瓶颈。在甄别现行劳动争议解决机制症结的基础上,围绕如何完善劳动争议解决机制,提出了做实协商、做大协调、做强仲裁、做精诉讼的思路与建议。
The current labor dispute settlement mechanism has fully covered consultation,mediation,arbitration and litigation-four kinds of ways,butproblems including power imbalance between the labor and the capital,weak positionof mediation committee inthe mediation mechanism,deviation of arbitration's function from targeted goals,judicial equality and fairness in litigation system become the bottleneck of restricting a timely and fair settlement of labor dispute.On the basis of identifying the crux of the current labor dispute resolution mechanisms and centering on how to consummate labor dispute solution mechanism,the paper provides a suggestion:truly carry out negotiation,amplify the role of meditation,strengthen arbitration and carefully handle litigation.
