摘要
简单叙述了我国建设工程价款优先受偿权的立法背景和现行规则,从法理方面进行深入的分析,同时,结合适用状况对其进行了评价。最后,本文站在建设工程企业的角度对其完善提出了建设性意见。
This paper simply describes legislative background and current roles of the priority right to be paid for construction enterprises ,then carries on the thorough analysis of this right from jurisprudence aspect .on this basis, we evaluate it by the situations of the application. At last ,in order to perfect this system, constructive suggestions were put forward by writer in the angle of the construction enterprises.
