摘要
法治是治国理政的基本方式,为良善社会秩序的形成提供了最佳的路径选择。绿色矿山构建是社会治理的有机组成部分,应在法治之下有序进行,坚持以人为本。尊重与保障人权既是法治的价值实质,亦是绿色矿山构建的终极价值追求。法治为绿色矿山构建提供制度保障,绿色矿山构建也必须贯彻法治理念。本文拟从安全生产、资源开发、环境保护和纠纷解决等四个方面,分析制约绿色矿山构建的法律问题,并提出了强化安全生产监管、完善资源开发立法保护、落实环境责任承担、依法构建矿山多元解纷机制等建议,以期促进绿色矿山构建在法治化的轨道上健康发展。
The rule of law is the basic way of governing the country,which provides the best choice to forming good social order. The construction of green mines is an organic part of social governance. It should be conducted in the rule of law, and adhere to people-oriented. Respecting and protecting human rights is the essence of the rule of law, which is also the ultimate pursuit of green mines construction. The rule of law establishes provisions for green mines construction, and green mines construction also must carry out the idea of the rule of law. This article will analyze legal questions from safe production,resource development, environmental protection, dispute resolution, etc. By strengthening safe production supervision, improving legislation to protect resource development, accepting environmental responsibility and resolving dispute in accordance with law, in order to promote the healthy development of green mines construction.
