摘要
修改后的刑事诉讼法首次以法律的形式规定了警察出庭作证制度。由于警察出庭作证在我国尚属新生事物,在实践中也没有相关经验和司法解释可以参考,因此大多数侦查人员从心理上并未完全接受警察出庭作证制度,新法实施后一旦以证人身份走上法庭必将面临种种问题。为此,公安机关应当未雨绸缪,结合队伍现状,从多方面入手,通过理念灌输、强化庭审培训等方式及时适应这一发展。
The amended Criminal Procedure Law for witnesses to give evidence and witness protection is better defined.It establishes the police witness system for the first time.Police witness will be an inevitable trend.However,the new law has just been enacted soon so that we don’t have the relevant experience and interpretation in judicial practice in China.Most police can’t accept psychologically and actively adapt to this development.They will face various problems once they appear in court to testify.Combined with the status of the public security force,the investigation organ should adapt to this development timely through indoctrinating the concept and the intensive training.
