摘要 劳务派遣是指劳务派遣单位与用工单位,根据有关规定,通过协商签订有关的协议,把劳动者派往用工单位,使其在用工单位的监督管理下提供劳动的用工方式。企业使用劳务派遣用工形式,具有其独特的优越性。但从实践来看,劳务派遣用工还存在一定的缺陷与不足。企业如果不按照有关法律规定使用劳务派遣用工,势必给企业带来法律风险,造成不可避免的损失。企业对于使用劳务派遣用工存在的法律风险应给予足够的重视,更要认真防范,利用优势,规避风险,减少损失。 Labor dispatch staffing firms and the accepting unit, according to the relevant provisions of the signing of the relevant agreement through negotiation, the workers assigned to labor units, to labor and employment in the supervision and management of labor units. The corporate form of labor dispatching has its unique advantages. However, from a practical point of view, the labor dispatch also exist some defects and shortcomings, enterprise, if not used in accordance with the relevant laws and regulations labor dispatch, it is bound to bring legal risks, resulting in the inevitable loss. Enterprises for the use of dispatch labor legal risk should be given adequate attention more seriously to prevent use of the advantages, avoid risks and reduce losses.
