摘要
《尚书》等文献所记录的象刑作为尧舜时代的主要法律制度,体现了早期以教化为上的法律观,其特征与原始社会的德治方式及耻感文化类型相吻合,且其初始精神影响到后世法律的文化特征。
The record about Symbolic Punishment in many Chinese ancient literatures, The Book of History, for example, reflected the ＇education first＇ of the early legal concept. Its characteristic coincided with the rule of virtue in primitive society and the Shame Culture type. Its original spirit affected the later legal cultural characteristics.
