摘要
传统商标侵权认定理论主要包括混淆理论、淡化理论和联想理论,其最大贡献在于为商标混淆侵权行为和商标淡化侵权行为的认定提供了合理解释,但其局限在于对反向假冒侵权行为和商标处分侵权行为缺乏解释力。商标侵权认定理论的探索,应当与时俱进。吞噬理论和处分理论的创立,为反向假冒侵权行为和商标处分侵权行为的认定提供了理论依据。混淆理论、淡化理论、吞噬理论和处分理论各有针对,互为补充,共同构成完整科学的商标侵权行为认定理论体系,对于指导商标立法和司法实践具有重要意义。
The traditional theories on the determination of trademark infringement mainly include the confusion theory, the dilution theory and the association theory. Those theories can reasonably explain the trademark-confusion infringement and trademark-dilution infringement. However, they can not give a reasonable explanation on the reverse passing-off infringement and the untitled disposal infringement. The theoretical exploration should keep pace with the times. The creation of the theory of trademark swallow and the theory of trademark disposal can provide theoretical bases for the determination of reverse passing-off infringement and trademark disposal infringement. The confusion theory, the dilution theory, the swallow theory and the disposal theory aim at explaining different trademark infringements, filling up the vacancy of each other, and constitute an integrated and scientific theoretical system for the determination of trademark infringement in together, which is of great significance to guide the legislative and judicial practice of trademark.
