2012年7月哈萨克斯坦《长输管道法》正式生效,之后哈国陆续出台一系列政府命令对该法进行完善和细化。该法律旨在保障哈萨克斯坦国家能源及生态安全,保证哈国境内原油和天然气长输管道安全、可靠及高效运行;并以法律的形式优先保证哈国内用户对原油及天然气的需求,在此基础上进行出口销售。该法规定了在长输管道领域哈萨克斯坦政府拥有国家优先权,并提出了国家运营公司的概念。该法规定的国家优先权、国家运营公司及长输管道油品接入顺序将影响中方股东对合资公司的掌控,并可能对哈萨克斯坦通过中哈原油管道向中国方向输油产生影响。
Kazakhstan's long distance pipeline law came into effect in July, 2012. From August to December of that year Kazakhstan's Oil & Gas Ministry issued a series of orders to complete and refine the law. The law is designed to guarantee national energy and environmental security and ensure that long-distance pipelines for shipping crude oil or natural gas operate safely, reliably and efficiently within Kazakhstan. The law ensures priority of domestic-user demand over exports. The law defines the vesting of long-distance pipeline ownership, redefines long-distance pipeline protected areas and expands the scope of pipeline protection zones. The law stipulates that the government of Kazakhstan has national priority in long-distance pipeline disposition and puts forward a new concept of 'national operator'. National priority, national operator and priority of access to long-distance pipelines affect Chinese shareholder control over the China-Kazakhstan long-distance crude-oil pipeline joint venture and oil transportation through it.
