摘要
在追求社会正义的现代社会,保护弱者的合法权益具有重要意义。就国内情况而言,保护弱者是对人权的重要保障,是建设社会主义和谐社会的必然要求。从国际角度来看,随着中国日益崛起,并以大国的身份跻身于世界民族之林,中国有责任、有义务承担起大国责任,起到一定的先锋模范作用,为世界各国人民提供一个公平正义的社会法制环境,使弱者的利益得到真正的维护。本文分析了我国《涉外民事关系法律适用法》中对弱者利益进行保护的规定,并指出国际私法弱者保护中应注意的问题,以期我国国际私法中的弱者保护能够具有更强的可操作性和可实现性。
It is of great significance to safeguard the rights of the disadvantaged as an indispensable component of human rights protection in such a modern society which upholds social justice,and this is especially important in China today,when constructing a harmonious society is in process.On the other hand,as an uprising great power in the world,China should and must undertake its responsibility in building a social and legal environment of just and righteousness,and play a model role in the disadvantaged rights protection.The paper analyzes the prescriptions regarding protecting the rights of the disadvantaged in Law of the People’s Republic of China on Application of Laws to Foreign-Related Civil Relations,and points out the matters which are worth noticing,so as to better operationalize and realize the regulations.
