摘要
货物运输合同的性质为第三人利益合同,收货人为受益第三人。目前我国铁路货物运输合同的收货人属于"经由被指令人而为交付"之第三人。为保护收货人的信赖利益,在我国未来立法上应当将铁路运输合同中的收货人确定为具有第三人利益合同之受益人的法律地位。
Contract of railway freight transportation is one of the contracts for the benefit of the third parties, generally with the consignee as the third party. However, the third party is re-ferred to as ＂by the instruction and delivery＂. In order to safeguard the trust-benefit of consignee, the legal status of the consignee of contract of railway freight transportation must be identified and specified as the third party beneficiary in law of our country in the future.
