摘要
《中华人民共和国海商法》是具有前瞻性和先进性的法律,推动了中国航运和贸易的发展。在当前时代背景下,也出现了一定的不适应性。推进海商海事法律理论研究与立法实践,是发展海洋经济,推进海运强国、海洋强国战略的必然要求。
The Maritime Code of the People＇ s Republic of China was a prospective and advanced legislation, it promoted the development of China＇s maritime transport and trade. In the current era, however, some unsuitability has appeared in the Maritime Code of the People＇ s Republic of China. Improving theoretical research of comprehensive maritime and admiralty law and its legislation practice is the inevitable requirement for scientific development of marine economy and promoting the strat- egy of being of maritime transport powerful nation and ocean powerful nation.
