摘要
期货市场既是套期保值者规避风险的市场,也是投机者风险投机的市场。法制化的期货市场才能保证其对市场风险的兼容性。交易公平、市场公正、信息公开、风险管控彰显了期货市场的本源性价值,是期货市场法制化建设的价值追求,是构建期货市场法律法规体系的基石。在当前形势下,为破解影响我国期货市场持续发展的制度性障碍,促进我国期货市场实现从量的扩张向质的提升转变,必须结合发达国家期货市场的经验,重构我国期货市场法律法规体系,加快期货市场法制化建设进程,尽快制定出台期货基本法。
The futures market is the arena for both hedgers to eliminate further risk and oppor- tunists to conduct speculation. A legalized futures market ensures the compatibility of unpre- dictable market risk. Fair trade, market justice, transparent information and sound risk man- agement are of essence for the derived value of the futures market, and therefore become of pursuit of legalizing futures market and the corner stone for its regulation system. In combina- tion with the experience of the fatures market of the advanced conatries, it＇s important to re- structure china^s legal system of the fatures market, hasten the constraction process of legali- zation and formulate Basic Law for the futures market. Such measures will help mitigate insti- tutional barriers of futures market sustainability and promote the progress from quantitative expansion to qualitative improvement.
