摘要
从不同角度考察视听作品,将呈现不同的属性。文章从视听作品的属性出发,借鉴西方国家的立法体例,认为导演、编剧、专门为视听作品创作的音乐作品的作者等为视听作品的合作作者,享有视听作品的原始著作权。为促进视听作品创作及其产业发展,在确立著作权归属问题上应当遵循意思自治优先原则;同时,实行"推定转让"制度,将在制片人与作者就视听作品著作权的归属问题没有合同约定或者约定不明时,视听作品的著作权转让给制片人行使。
Examined from different angles, the same audio-visual work will present us different properties. Proceeding from the properties of audio-visual works, and using the legal system of the Western countries for reference, this paper suggests that all of the directors, script-writers, authors of the musical work who specifical- ly create for audio-visual work should be considered as co-authors of the audio-visual works, and they can en- joy the original copyrights. To promote the creation of audio-visual works and the development of related industry, we should follow the principle of autonomy of priority when establishing the ownership of copyright; at the same time, the" presumptive transfer" system should be implemented where there is no contract or explicit agreement between producers and authors, copyrights shall be transferred to the producers of the audio-visual works.
