摘要
农村土地承包经营权是私权利,但由于农地承担着农民生存保障、粮食生产安全、生态文明建设等功能,农村土地承包经营权的流转就涉及公共利益、私人利益等多种利益的冲突。在农村城市化的大背景下,现行流转机制的利益失衡问题更为突出,因此必须平衡土地承包经营权流转涉及的各方利益,因地制宜,分类规范,构建合理的土地承包经营权流转机制。
Contract management rights of rural land are private rights, but agricultural lands undertake functions of the guarantee of farmer＇ s life, the safety of food production and the ecological civilization construction. Then the transference of the contract management right of rural land related to the conflicts of public interests and private interests. In the background of rural urbanization, unbalance of interests is more prominent. Therefore, we should balance the interests of all parties and construct reasonable mechanism of transference of the contract management right of rural land according to local conditions.
