摘要
《刑法修正案》(八)将"恶意欠薪"入罪,并最终定名为"拒不支付劳动报酬罪",体现了刑法在社会管理上的创新。这就使得入罪前有着极大争议的"恶意欠薪"在入罪后成为运用刑事手段介入民事纠纷的大胆尝试,也使得"拒不支付劳动报酬罪"成为运用刑事手段"一劳永逸"地解决社会问题的大胆探索。在正确理解及适用"拒不支付劳动报酬罪"的同时,综合多种手段共同解决"欠薪"的社会问题才是真正的关键所在。
Criminal Law Amendment ( The Eighth) eventually named the crime of "malicious back pay" as "crime of refusing to pay labor remuneration", which reflects innovations of Criminal Law in social management. It not only makes the highly controversial "malicious back pay" become a criminal means to solve civil disputes, but also provide a "once and for all" solution to "crime of refusing to pay labor remuneration". It is a bold at- tempt as well as a brave exploration. The key issue lies in integrating various means to resolve the problems of "back pay" through correct understanding and application of "crime of refusing to pay remuneration".
