摘要
目前对工伤事故认定通常还是依靠"工作时间、工作地点"等外在条件。随着工作方式的多样化,工伤事故发生也呈现复杂化趋势,实务界亟需一种原则性指导标准来对法无明文规定情况进行判定,即在"职业利益性"学说基础上增设"业务的隶属性",将二者重新确定位阶,形成适度对抗模式,从而避免工伤保险制度滑向保护范围过宽过滥的趋势。
Recently, work-related injuries are recognized by working time or places, which are objective conditions. But the working conditions are variable, the work-related accidents occur in a complex of conditions. A guiding principle is in great need to complement the laws to prevent the work-related injuries insurance from developing into a too wide or even wild range.
