摘要
1942年发生于甘肃甘南地区的"杨麻案",从案发到平息起伏延宕,影响巨大。通过梳理甘肃省档案馆所藏档案材料再现本案的真实图景,20世纪40年代的民国政府政权下移过程中国家政权、地方精英与当地民众等多方主体之间,在甘南藏区这一地域内,以利益争夺为指向,以权宜性地运用国家法和藏族习惯法为理据的博弈格局得以明朗化。
From its breakout to suppression the ＂Yang Ma Case＂ in 1942 in sou＇thern Gansu produced great impacts. A close reading of the case filed in the Archives of Gansu Province reveals a true picture that in the process of delegating the state power to the lower levels, the conflict between the local elites, local populace and national government was very fierce, each competing for benefits and powers by taking advantage of the national law and the Tibetan customary law.
