摘要
《湘西民族民间文化遗产保护条例》(以下简称《条例》)是我国较早对非物质文化遗产法律保护进行规定的民族自治立法,它有力地推动了湘西民族民间文化遗产的保护工作。随着理论研究的不断深入,相关立法经验的积累,特别是《非物质文化遗产法》的出台,其修订问题越来越迫切。论述《条例》修订的必要性,并提出一些修订意见。
＂Xiangxi National and Folk Culture tteritage Protection Ordinance＂ （hereinafter referred to as ＂＇Ordinance＂） is China＇s earlier autonomous legislation on the legal protection of non- material cultural heritage. It strongly promotes the work of Xiangxi national and tolk culture heritage protection. Along with the deepening of theoretical research, the accumulating experience of relevant legislation, especially the promlgation of ＂the law on intangible cultural heritage＂, the revision becomes more and more urgent. This paper discusses the neeessity of revising the ＂Ordinance＂, and puts forward some suggestions.
