摘要
文章认为,我国城乡发展不均衡的根本原因,在于农村土地集体产权尚未构建起有效的产权主体化及其治理机制,由此造成城乡土地权益失衡,进而导致集体所有权和农村生产力的空洞化。文章从集体产权主体化的一般机理出发,分析集体所有权空洞化的表现和成因,以及所有权主体及其权利归位等问题,进一步探索了农村土地集体产权关系重构中的治理机制等相关问题。
A fundamental reason for unbalanced development of urban and rural China is that an effective property rights substantivization and governance mechanism for the collective property rights of rural land has not been established. This creates imbalance between urban and rural land rights and interests, which leads to the hollowing out of collective ownership and rural productivity. This article begins by specifying a general mechanism of collective property rights substantivization, analyzes manifestations and causes of the hollowing out of collective ownership and the problems about subject of ownership and the rights to return. Then the paper further explores the governance mechanism and other related problems in the course of reconstruction of rural collective land property.
