摘要
西双版纳傣族传统上对南传上座部佛教的信仰,使他们独特的佛寺教育与义务教育之间产生了矛盾。"佛寺教育问题"的解决可以上升为宗教信仰自由与受教育权两项基本权利在同一主体产生的张力如何化解的层面。该问题为当前的基本权利冲突研究所忽略。只有在公民基本权利的辐辏结构的基础上的"存异"进路,才能通过构建宗教信仰自由与受教育权的矛盾的最佳均衡,从根本上解决"佛寺教育问题"。
The Dai people in Xishuangbanna believe in Theravada Buddhism and this causes a contradiction between their unique Buddhist temple education and compulsory education. Solving this problem makes a great difference in reducing the tension between the two basic rights of freedom of religion and receiving education. However, this issue is seriously neglected in present studies on conflict of basic rights. To resolve this issue, differences should be respected on the basis of convergence structure of citizens' basic rights and an optimum balance between the two basic rights should be made.
