摘要
社区矫正符合宽严相济刑事政策的要求,是刑罚轻缓化和刑罚人道主义的现代刑罚理念的具体体现。刑法修正案(八)及修改后的刑事诉讼法对社区矫正对象范围予以了规定,适用社区矫正制度就应当依据法律规定,不能任意扩大社区矫正的适用范围。对未成年人实施社区矫正,要坚持遵循教育、感化、挽救的方针,注重对其进行心理疏导。对老年社区矫正人员,应当以进行法制教育为主要内容,谨慎考虑开展公益劳动。符合社区矫正条件的流动人口罪犯应纳入其居住地的社区接受社区矫正,在不影响工作的情况下,有利于提高他们接受教育与改造的积极性及主动性。
The community correction should be in accordance with the criminal policy requirements of ＂tempering justice with mercy＂ and embody the present criminal punishment principles of＂ punishment mitigation and punishment humanitarian＂.Objects range of community correction has been provided in Criminal Law Amendment （Eight） and amended Criminal Procedure Law.Therefore, the community correction system should be applied according to the provisions and the range can not be expanded freely.When juveniles are corrected in the community,we should provide psychological help to educate influence and save them.For those old people we should conduct legal education and public welfare labor. For female criminals we should have some female staff to help them. For floating people they should be corrected in their residential area so as to make them actively corrected and educated.
