摘要
大学章程建设是完善中国特色现代大学制度的重点和难点。在大学章程建设中充分尊重和彰显学生主体性,是高等教育的本质使然。目前我国内地大学章程建设尚处于起步阶段,由于法律保障的缺失、传统教育观念的束缚、利益相关方关系的界定不明晰等方面的原因,学生主体性缺乏充分的尊重,致使大学章程在制定及其内涵表达上存在缺陷。为推进大学章程建设走向完善,笔者从生成路径、框架体系、治理结构、制度要素等四个角度出发,探讨了在大学章程建设中尊重和彰显学生主体性的方法和途径。
University statutes that is supposed to respect and project student subjectivity by nature is critical to the progress of modem university system with Chinese characteristics. However, in its infancy, it needs to be perfected in terms of connotative expressiveness and student subjectivity, which may be ignored on account of the deficient legal protection, the traditional norms of education and the undefined Sfakeholders. This paper, thus, aims to explore specific approaches and pathways from the angles of generation path, framework, governance structure and systematic elements to strengthen student subjectivity through the revised construction of university statutes.
