摘要
由于在执法职权分配、执法机构设置以及执法监督体系的设计方面存在弊端,中国现有的海洋环境执法体制已无法适应海洋环境执法的现实要求,这对中国海洋环境执法活动的顺利进行造成了严重阻碍。为了彻底消除上述弊端,必须在职能分配、机构设置、监督体系等方面对中国的海洋环境执法体制予以重构。
Because of the drawbacks existing in the law enforcement authority assignment, the law enforcement agency establishment and the law enforcement supervision system designment, the existing marine environment law enforcement system of China has been unable to adapt to the requirement of Chinese marine environment law enforcement reality, which has created substantive hindrance to the proper enforcement of Chinese marine environment law. In order to thoroughly eliminate the above-mentioned drawbacks, we must restructure China＇s marine environment law enforcement system by assigning the authority, establishing the agencies and designing the supervision system scientifically and properly.
