摘要
中国传统文化一直强调中庸,以和为贵,认为诉讼不利于社会安宁与和谐关系,但官府还是支持正义的诉讼。在宋代的诉讼文化中,强调的是息讼,甚至无讼,对于妄讼官府的处罚尤其严厉,这有利于司法资源的有效利用。《名公书判清明集》向我们集中展示了古代司法官的息讼方式,值得当今司法诉讼借鉴。
Chinese traditional culture has emphasized the doctrine of the mean and harmony.In the culture, litigation is not conducive to social peace and harmony.But the government is for justice litigation.The litigation culture of the Song Dynasty emphasizes stopping litigation,or even no litigation,and official punishment for false litigation is especially severe, which is conducive to the effective use of judicial resources. Enlightened Judgments showed us how the ancient judicial officer stopped litigation,which is worth reference in the present judicial proceedings.
