摘要
为深入认识林权及林权结构、消除实际工作中的认知错误,在明确林权和林权结构概念的基础上,以林权主体数量为依据,将林权结构划分为单主体林权结构和多主体林权结构2种基本类型,详细分析了各自的配置方式,并以图解的形式使其具体化和形象化。结果表明:林权客体的复杂性和权利的可分割性使得林权结构复杂多样,林权结构直接影响着林权激励和约束功能的发挥。因此,确权工作应围绕构建激励相容的林权结构深入展开。
In order to know forest property rights and its structure in deep, eliminate the misunderstandings in the actual work, on the bases of clearing the concept of forest property rights and forest property rights structure, the author divided forest property rights structure into two basic types of single main and multi- agent in accordance with the number of the main body of forest property rights, and then analyzed the respective configuration in detail, as well as adopted the diagram form in order to make forest property rights structure more specific and visualization. It was concluded that forest property rights structure was so complex and diverse just because of the complexity of the object of forest property rights and the severability of the rights, and forest property rights structure affected the incentive and constraint functions of forest property rights directly, so the work of determining the forest property rights should be carried out deeply focusing on building forest property rights structure with the functions of incentive compatibility.
