我国房地产价格法律调控制度问题研究

摘要 房地产价格是关系到民生的焦点问题。尽管我国采取了众多的房地产价格调控政策,但收效并不明显。反思根源,实则凸显了我国现行法律在制度调控层面上的乏力,存在着土地制度短视、税收制度不合理、金融信贷制度不公正等问题。必须改革土地出让制度,调整土地收益分配模式,加大对房地产持有环节的征税力度,通过设立住宅金融公库扶持自有住宅消费,打击投机需求,建立公平的信贷制度,真正实现房地产价格的合理回归。 The real estate price is the focus issue closely related to people's livelihood. China has implemented a large number of real estate price regulation and control policies with no significant effects. Reflections on the root causes would highlight the weakness of current laws on system regulation level, and reveals problems of short-sighted land system, irrational tax system, unjust financial and credit system. The administration must reform the system of land transfer, adjust land revenue allocation model, set stiffer tax on real estates held by links, support the individual's own residential consumption through the establishment of the Housing Finance Corporation, crack down on speculative demand, and establish a fair system of credit, so as to keep real estate prices at a reasonable level.
