摘要
跨行政区域水污染纠纷是政府之间的纠纷,属于公务纠纷。其涉及多个政府主体,解决难度大。我国跨行政区域水污染纠纷解决机制主要包含和解、调解两种方式,该机制的根本缺陷在于诉讼机制的缺失,法律强制效力不足。完善该机制的关键是建立地方政府间诉讼。建立政府间的诉讼具有合理性和合法性,此类诉讼由共同的上级政府所在市的人民法院管辖,可以调解。
Most of water pollution disputes across administrative areas are between governments, they are official disputes. As involving a number of government body, it is so difficult to solve them. Chinese settlement mechanism of water pollution disputes across administrative regions consists of two ways of reconciliation and mediation. The fundamental flaw of this mechanism is the absence of litigation and lack of effectiveness. The key to perfect the mechanism is establishing the local government litigation. The intergovernmental lawsuit legitimacy has theoretical and empirical base. Such proceedings are governed by the common superior court, and can be mediated.
