摘要
确定夫妻财产中知识产权归属时,实证法规则以利益衡量方法为指导,在夫妻之间进行利益衡平。然而所得之实证规范效力极易为夫妻一方通过各种不合理方式加以规避,使规范目的落空,从而导致利益冲突难题仍然存在。为解决该难题,应在理论允许的范围中,确定一新规则,避免上述问题,并达到利益衡量的更佳结果。
Positivist rules,with regard to the determination of the attribution of intellectual property rights in marriage,are generally adopted to balance the interests of both wife and husband by means of interest measurement.However,in some cases,the efficiency of the positivist determination may not come into effect because one party of the conjoints takes some unjust measures to circumvent it,which may result in some conflicts over interests.To solve the problem,and also reach a better result,some new rule is expected to be determined and put into effect.
