摘要
演绎作品的构成要件决定了它的双重属性:对已有作品的依赖性和相对于已有作品的独创性。而演绎作品的双重属性则决定了其权利的行使也具有两面性:一方面,演绎作品的著作权人对其创新部分享有独立的著作权;另一方面,当行使权利涉及到已有作品的表达元素时,必须获得已有作品著作权人的授权许可。因此,当再次演绎所演绎的作品时,根据是否涉及到已有作品的独创表达元素,决定了授权条件是单一授权抑或是复合授权。
The formation conditions of deductive works decide its double attributes： The one is the dependence of existing works;the other one is relative to the originality of existing works.These double attributes decide exercising of rights have two sides：One hand is that the copyright of deductive works has the independent copyright for the innovation;On the other hand is that he must get the authorization from the copyright of existing works when exercising of rights involve to the expression elements.As a result,the dependence on existing works decides the licensing condition is a single license or a composite authorization when doing another interpretation.
