摘要
近年来,在对日劳务派遣业发展的同时,纠纷也日益增多。本文通过一个案件从起诉、审理到执行的过程,对比分析中日两国在涉外劳务纠纷的法院管辖、冲突规范、准据法以及对外国法院判决的承认与执行等方面的法律规范,并为被派日劳动者提供了一套解决劳务纠纷的国际私法维权模式。
Recently, with the globalization, the economy integration of China and Japan is increasing incredibly. At the same time, the labor cooperation of resource and technology is more frequently as well. Among all the countries that provide labor resources to Japan, China has been the first for a long time. However, with the development of the labor dispatching, the number of the labor disputes is also increasing, the typical case is the Huangshi women workers tortured in Japan. From the perspective of this case, this article will focus on the procedure of the litigation. It will compare and analyze the different provisions between Chinese and Japanese conflicts law and applicable law, including the provisions of jurisdiction, etc. This essay wants to finally provide a rights protection mode of Private International Law which can at maximum help the dispatching workers working in Japan to assert their fights.
