摘要
在我国强力维稳的背景下,理性执法之于公安机关具有特殊的意义和价值。理性执法基于公安民警的政治意识和大局意识,强调公安民警对执法环境全面、理智的权衡和分析,正确恰当运用法律,兼顾情理,达到执法的法律效果、政治效果和社会效果的统一。相对于平和、文明、规范执法,理性执法具有政治性、思维性、理智性、统一性、沟通性的特点。在维稳背景下,公安机关理性执法具有政治价值——有助于提高公众的政治认同度;警务价值——有助于良性沟通降低社会风险;社会价值——有助于培育理性平和的社会心态。
Under the background of maintaining stability in China,the rational law enforcement is very important and valuable to the public security organs.Based on the police＇s political and overall consciousness,the rational law enforcement emphasizes the police＇s comprehensive,rational balance and analysis on law enforcement environment,proper use of the law and giving consideration to feeling and principles in order to realize the unity of law,political and social effect.Relative to peaceful,civilized and standard law enforcement,the rational law enforcement has the characteristics of politics,thinking,reason,unity and communication.Under the background of maintaining stability,the rational law enforcement of the public security organs has politics value-helpful to raise the public＇s political identity,policing value-helpful to reduce social risk through positive communication,society value-helpful to cultivate social mentality of rationality and peace.
