摘要
当今社会,"实名制"已经不再是什么稀罕词,如火车票实名制、博客实名制、手机实名制等等。2009年12月31日福建省食品药品监督管理局下发《关于加强紧急避孕药品监督管理的通知》,规定顾客去药品零售企业购买紧急避孕药品时必须登记详细的个人信息资料,对购买紧急避孕药实行实名制。但该规定在之后的实施过程中出现了一系列的问题,引起了公众的广泛争议。尽管2011年12月29日,福建省食品药品监督管理局再度下发《关于进一步加强紧急避孕药品监督管理的通知》,宣布2009年的通知废止,但是这一事件却引发了对政府行为与私权保护之关系的法律思考。
Nowadays "real-name system" is rather universal, and widely used in different areas, including tickets, blog, cell-phone and so on. The Notification on Strengthening the Supervision and Management of Emergency Contraceptives was issued by Fujian Food and Drug Administration on Dec. 31, 2009, which regulates that customers personal details should be registered when they purchase emergency contraceptives. However, it caused widespread controversy because of problems in the implementation process. On Dec. 29, 2009, The Notification on Further Strengthening the Supervision and Management of Emergency Contraceptives was issued by Fujian Food and Drug Administration, which announced the termination of the notification in 2009, whereas this incident has caused extensive legal reflection on government act and protection of individual rights.
