摘要
认定夫妻一方债务是否为夫妻共同债务,目前主要的法律依据就是最高人民法院关于适用《中华人民共和国婚姻法》若干问题的解释(二)第二十四条的规定。但是该规定单纯以债务形成时间是否形成于婚姻关系存续期间为依据,形成了将夫妻一方债务认定为夫妻共同债务的一般性推定规则,在理论、立法和实务上均显不足,因此,该条规定有待于进一步的完善。
To identify one of the spouses debt is the common debts or not the current principal legal basis is the Supreme People＇s Court on the application of the marriage law interpretation of several issues （two） the provisions of article twenty-fourth. But the provision only regards the debt formed during the existence of marriage relationship as the basis, which will be one of the spouses debt as the common debts of the general presumption rules, in theory, legislation and practice are insufficient, the article to be nec- essary to perfect and response.
