摘要
当代中国女性退休制度非常复杂,女工人、女干部、女高级专家及处级以上干部的退休年龄分别为50岁、55岁、60岁,另外从事重体力、有害健康的工作以及丧失工作能力的女性,退休年龄为45岁。这种复杂的退休年龄标准,使用人单位在决定女性劳动者是否退休的问题上可以选择性地适用法律和政策,而且对相关规定任意解释,致使一些女性被迫提前退休,遭受经济上和精神上的双重损害。为了解决这一问题,笔者分析了目前女性退休制度对女性的侵害及制度缺陷,由此提出了有关法律改革的基本原则。
It is very complicated about female retirement system in China.The retiring age of female worker,female cadre,female senior expert and senior cadre are 50,55,60 respectively.Besides,female workers who undertake heavy physical labor or harm healthy work can retire at age 45.These complicated retiring norms make the employers choose the laws or policies freely to decide whether the women should be retired and,the employers usually interpret the law or policy arbitrarily.Thus many women were forced to retire from the positions earlier and suffer the shocks both on the economy and the spirit.In order to resolve this problem,the author analyzed the harms which women suffered and the defects of the system and put forward the basic principles of legal reform.
