摘要
随着社会主义市场经济发展和城市化进程的加快,农村土地承包经营权流转制度在实践中产生了许多问题,成为制约我国土地制度改革,建立健全土地市场的一大障碍。文章在对现行农村土地承包经营权流转制度进行研究的基础上,在土地承包经营权的登记、抵押和继承三方面进行制度创新,以期完善现行的农村土地承包经营权流转制度,促进农村土地承包经营权合理有效流转。
With the development of the socialist market economy and the acceleration of urbanization process, the system of circulation of the contractual management right of rural land has led to many problems in practice. And it has become a constraining problem of China＇s land reform as well as the bottleneck of the establishment and improvement of land market. On the basis of studying the current of system of circulation of the contractual management right of land, this article try to work out the system innovation in the registration, mortgage and inheritance to improve the existing system, and to promote rational and effective circulation of the contractual management right of rural land.
