摘要
广深港高速铁路是连接港粤的重要交通通道,选择何种运营模式更有利于两地的经济发展与人员交流值得研究。从法律角度分析大陆和香港两个法域或区际之间的法律问题,认为采取跨境铁路运营模式中的协议模式最适宜广深港高铁的运营,该模式可以解决两种跨境铁路运营模式面临的法律困境,而且有一定的现实经验做基础。
Guangzhou-Shenzhen-Hong Kong high-speed railway is an important transportation route between Hong Kong and Guangdong. It is worthy to research that which kind of operating mode is more conducive to both economic devel- opment and personnel exchanges. Analysis on the legal issue between the two law systems of Chinese mainland and Hong Kong from the aspect of law, this paper argues that adopting the agreement mode of cross-border railway opera- tion mode is the most suitable for the Guangzhou-Shenzhen-Hong Kong high-speed railway. This mode not only can solve the legal dilemma faced by the two cross-border railway operating modes , but also can use some practical experi- ence as a basis.
