摘要
中华法系的本质属礼法,《尚书》在礼法形成发展中具有决定性地位。西汉以降,礼法研究未能澄清两大问题:一是信史时代宜从何时起算。二是孔子序纂《书》可否视为更改史料。此二问题的解答在今日尤其重要。它约束着中华礼法体系研究的系统化。考证揭示,基于伯夷的记时精确性,中华礼法信史断代应定在尧舜时期,而非夏朝。讨论揭示,孔子以良史之能纂序《尚书》,这根本不是更改史料,而是升华《坟》《典》内涵。此讨论结果为礼法研究夯实了基础。
The essence of the Chinese law system belongs to the rites law, while the "Book of History" plays a decisive role in the building and development of the Chinese rites law. Since the West Han Dynasty, the research of the rites law has not clarified two problems. The first is when the authentic history begins. The other is whether Confucius' cataloging of the "Book of History" can be considered as a revision of the historical materials. The answer to these two questions is of importance in particular today, because it dominates the systematization of the research on China's rites law system. The textual research reveals that based on the accuracy of timing Bo Yi, the Chinese authentic history begins at the governing period of Yao, but not at the Xia Dynasty. The discussion also brings to light that, instead of revising historical materials, as a professional historian, Confucius cataloged the "Book of History" to refine the connotations of the "Grave" (坟) and the "Canon"(典). The result of this discussion has solidified the foundation for the research of rites law.
