摘要
新能源产业是世界大国竞相发展的战略性新兴产业。新能源技术转让是我国获取新能源技术的重要渠道,是促进产业转型升级、提高产业竞争力和促进节能减排、缓解气候变化的关键。新能源技术知识产权成为国际新能源战略博弈的焦点,知识产权政策是影响技术转让的基础性制度。我国知识产权法律及政策虽然经历多次修订和完善,仍不能适应日益增加的外国新能源技术转让的需要。我国有必要继续完善知识产权政策环境,需要强健的知识产权保护,促进我国新能源产业发展和技术转让。
New energy industries are the strategic emerging industries that larger countries compete each other in the world. Technology transfer of new energy is one of the main channels for China to get new energy technologies, and is the key to promote the industrial transformation and upgrading, increase industrial competitiveness, push energy conservation and emission reduction, as well as alleviate climate change. Intel- lectual property of new energy technologies has become the focus that larger countries game in new energy strategies. Intellectual property policy is a basic institution that influent the technology transfer. Although China has amended and completed the laws and policies of intellectual property for many times, it still cannot fit the needs of more increasing foreign technology transfer of new energy. China needs to continuously accom- plish the policies environment of intellectual property, and needs stronger intellectual property protection to boost new energy industry development and technology transfer.
