摘要
《汉书·董仲舒传》所录"天人三策",是广川董子与汉武帝为此后两千年创制立法之对话,为孔子之后最为重要的政治哲学与政治文献,也深刻显示了儒者通过理论思考参与改制立法之进路。董子具有政治科学、宪法科学之思维模式,超越了政治浪漫主义,显示了政治成熟之心智。他发展了天道治理观,立足于当时政治现实,承认皇帝之地位,但通过设计一些看起来不那么引人注目的制度,分散、约束乃至控制皇权,最终实现"行道于天下"之目的。
The Three Answers to Governance between Heaven and Man is an epoch-making dialogue between Dong Zhongshu and Wu Emperor of Han Dynasty, which conceives of the fundamental constitution for the future 2000 years’ China.As the most important literature in political philosophy and politics, it displays a classical Confucian approach to change constitutions and make laws through theoretical conception. This paper annotates this great text and discovers, Dong’s way of thinking is politic and constitutional, and Dong has a sense of the complexity of politics, refrained from politic romanticism. Based on his view of Heaven’s way, the conception of ideal governance accepts the authority of the emperor institution established by Qin and succeeded by Han, but devises some other delicate institutions aiming to decentralize, check and control the power of the emperor, develops it as a tool to realize Confucian ideals.
