摘要
中国正在构建中的劳动争议"大调解"体系,其效率取决于劳动争议民间调解协议的效力。由于劳动争议民间调解协议的效力不含有强制执行力,难以实现有效拦截劳动争议案件进入仲裁或诉讼程序的目标,实践中创建了民间调解协议效力加固的两种模式,即司法确认和仲裁置换,而这两种效力加固模式在实践中存在诸多缺陷。建议就劳动争议民间调解协议的效力及其加固,遵循如下思路完善立法:统一规则并提高位阶、公平正义与效率并重、突出劳动争议调解协议特殊性。
China' s "grand mediation" system of labor disputes is under construction and its efficiency depends on the effect of civil mediation agreements of labor disputes. However, the effect of mediation agreements is not endowed with the compulsory execution force so that the arbitration and litigation procedure of labor dispute cases can not be effectively prevented. Two consolidation modes of civil mediation agreements' effect, namely, the judicatory affirmation and the arbitral displacement, have been created and established in practice. However, there exist defects in the two modes. The paper proposes that perfection of legislation, unification of rules, enhancement of hierarchy, equal attention to fair justice and efficiency, and highlights of the particularity of mediation agreements of labor disputes should be carried out to consolidate the effect of mediation agreements of labor disputes.
